These Terms & Conditions ("Terms") govern your access to and use of the DispatchDesk website located at dispatchdesk.ai (the "Site") and any related products or services we provide (collectively, the "Services"). By accessing or using the Site or Services, you agree to these Terms. If you do not agree, do not use the Site or Services.

1) Who We Are

DispatchDesk ("DispatchDesk," "we," "us," or "our") provides an AI-powered call answering and scheduling service designed for service businesses.

2) Use of the Site

You agree not to misuse the Site. This includes (but isn't limited to):

  • Attempting to gain unauthorized access to the Site or systems
  • Interfering with the Site's operation or security
  • Using the Site for unlawful, harmful, or fraudulent activity
  • Copying, scraping, or reverse-engineering the Site or its content without permission

We may suspend or block access if we believe you are violating these Terms.

3) Service Descriptions & No Guaranteed Results

We may describe features, capabilities, or expected outcomes of our Services. Unless you have a separate signed agreement with DispatchDesk that explicitly includes a performance guarantee, we do not guarantee specific results (including revenue, booked jobs, lead volume, conversion rate, or profitability). Outcomes depend on many factors outside our control, including your call volume, business operations, staffing, pricing, and market conditions.

4) AI, Call Handling, and Accuracy

Our Services may use automated systems and AI to answer calls, collect information, summarize conversations, and schedule appointments. While we aim for high accuracy and a professional caller experience:

  • AI may misunderstand, mis-transcribe, or misclassify information
  • Scheduling availability depends on calendar configuration and real-time connectivity
  • You are responsible for reviewing bookings and call details and confirming operational fit

5) Customer Responsibilities (If You Use DispatchDesk)

If you become a DispatchDesk customer, you agree to:

  • Provide accurate business details, service area, and intake rules
  • Maintain accurate scheduling availability and dispatch/appointment capacity
  • Configure call forwarding/routing as required
  • Comply with applicable laws and regulations, including consent requirements for call recording and messaging where applicable
  • Use the Services in a way that does not violate any law or third-party rights

6) Messaging Terms (SMS)

If you provide your phone number, you consent to receive communications from DispatchDesk related to your inquiry, onboarding, support, or service updates, including via SMS where applicable.

  • Opt-out: Reply STOP to unsubscribe from SMS messages at any time.
  • Help: Reply HELP for assistance.
  • Message frequency: Varies based on your activity and relationship with DispatchDesk.
  • Rates: Message and data rates may apply.
  • Carriers: Carriers are not liable for delayed or undelivered messages.
  • Privacy: SMS consent is not shared with third parties or affiliates for marketing purposes.

7) Intellectual Property

The Site, branding, text, graphics, UI, and underlying software are owned by or licensed to DispatchDesk and are protected by intellectual property laws. You may not reproduce, modify, distribute, or create derivative works from our content without written permission.

8) Payments, Trials, and Refunds

If you purchase Services from DispatchDesk, payment terms (including any setup fees, subscription fees, usage fees, minimum terms, and cancellation terms) will be governed by a separate written agreement, invoice, or checkout terms provided at the time of purchase.

Unless a separate agreement says otherwise:

  • Fees are non-refundable
  • You are responsible for any third-party usage charges (e.g., telephony/SMS/AI usage) incurred under your configuration

9) Third-Party Services

We may integrate with or rely on third-party services (e.g., telephony providers, AI providers, calendar tools, analytics). We are not responsible for third-party outages, disruptions, pricing changes, or service interruptions.

10) Disclaimers

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DISPATCHDESK WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES.

IN ALL CASES, DISPATCHDESK'S TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SITE OR SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO DISPATCHDESK IN THE THREE (3) MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF YOU HAVE NOT PAID DISPATCHDESK ANY AMOUNTS).

12) Indemnification

You agree to indemnify and hold harmless DispatchDesk from claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or Services, your violation of these Terms, or your violation of any law or third-party rights.

13) Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles.

14) Changes to These Terms

We may update these Terms from time to time. Updates will be posted on this page with a revised "Last Updated" date. Continued use of the Site after changes means you accept the updated Terms.
